CONSUMER CREDIT FILE RIGHTS

UNDER STATE OF TEXAS AND FEDERAL LAW

You have the right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor any credit repair organization has the right to have accurate, current, and verifiable information removed from your credit report.

The credit bureau must remove inaccurate, incomplete, or unverifiable information. However, the credit bureau is not required to remove accurate information.

You have the right to obtain a copy of your credit report from a consumer reporting agency. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding sixty (60) days.

You have the right to dispute inaccurate or incomplete information in your credit report. If you dispute information, the consumer reporting agency must investigate the disputed information unless the dispute is frivolous. If the investigation reveals that the disputed information is inaccurate, the consumer reporting agency must remove or correct the item.

The consumer reporting agency must complete the investigation within thirty (30) days unless it considers the dispute frivolous.

If inaccurate information is removed, it may not be reinserted into your credit report unless the furnisher of the information verifies that it is complete and accurate.

Accurate negative information may remain on your credit report for up to seven (7) years. Bankruptcy information may remain for up to ten (10) years.

You have the right to cancel your contract with any credit services organization for any reason within three (3) business days from the date you signed the contract.

You may also contact the consumer reporting agencies directly:

If you believe a credit services organization has violated your rights under state or federal law, you may contact the Texas Attorney General’s Office or the Federal Trade Commission.
